Terms and Conditions
These terms and conditions (or “Agreement”) is an agreement between Sweet Excel (“we”) and you (“User” or “You”). This agreement entails general conditions, condition on products/services as well as your participation in any activities related to Sweet Excel (collectively, the “Website” or the “Service”);

User Accounts and Members
If you have created an account on the website You are responsible for the security of your account and you are responsible for all activities that occur under the use of the account or any other actions related to that account. We may monitor and verify new accounts before you log in and use our services. Providing false contact information of any kind may result in the termination of your account. You must notify us immediately of any unauthorized use of your account or any other breach of security. We may suspend, disable or delete your account. (or either) if we determine that you have breached any term of this Agreement or that your actions are likely to damage our reputation and goodwill. If we delete your account for the above reasons You will not be able to re-register to use our services. We may block your email address and Internet Protocol address to prevent re-registration.

User Content
We do not own any information or content that you provide on the Website for the use of the Service. You are responsible for the accuracy, quality, completeness, legality, credibility and is a sole ownership of all intellectual property on the content submitted. We may observe and monitor content on the Website that you submit to or create. Your use of the Website does not grant us permission to use, reproduce, modify, publish or distribute content that you create or store in your account for commercial purposes. Marketing or any other similar purpose unless you specifically authorize us. However, you grant us the right to access, copy, distribute, store, transmit, reformat and display the content of your account as required as it is set for the purpose of providing services to you only. We reserve the right to reject or remove any material that violates our policies, is inappropriate, or is in any way detrimental to the terms and conditions at our sole discretion.

Billing and payment
You will be required to pay any fees or surcharges to your account in accordance with the due fees, surcharges and billing requirements. In the event that a free trial of the service is offered you may be required to pay after the free trial period has ended not when you enter your billing details. (This may be required prior to the start of the free trial). If automatic renewal is enabled for the Services you have opted into you will be automatically charged according to the conditions you have chosen. If we consider your transaction to be a high-risk transaction we will ask you to provide a photocopy of the card holder’s government-issued photo card or a copy of the most recent bank statement for the credit or debit card used for the purchase.

We reserve the right to change the product, service, price, product or service and activities related to Sweet Excel at any time and we reserve the right to refuse any orders you place with us. We may limit orders at our discretion.

These restrictions may include orders made by or under the same customer account, the same credit card and/or fee-charged orders, and/or the shipping address. In the event that we change or cancel the order We will notify you by contacting you via email you provided while placing your order.

Sweet Excel offers products and services for distribution. When we receive your order and payment of fees and the payment of that fee has passed a fraud investigation, we will grant you the right to access the purchased product or service as soon as possible. Free products have a system limitation. All fees are non-refundable.

Refund Policy
Because our website offers products and services that are intangible and irrevocable after we have granted you access. We therefore reserve the right to refuse giving a refund in any circumstances after payment has been made for the product/services, in which you acknowledge before purchasing any products and services on the website (by checking the box that you have read the Terms and Conditions as well as Refund Policy before placing order). Please read the service description carefully before making your purchase.

Different types of licenses
1. Individual (Single-user License): Receipts cannot be issued on company name, including other details such as address, email address, phone number, tax payer ID, etc.

1.1 All ready-to-use templates such as Multipurpose Template, Dashboard, etc. are copyright of Sweet Excel which allows buyer (licensee) to download files, get updates and ask for support according to the time limit stated. And can be used for personal work such as making a presentation or a report and use the finished work or “End Product” in the presentation. But buyer is not allowed to bring Template files that are not finished work or “End Product”, whether in whole or in part, transferred, distributed, or sold elsewhere. Sweet Excel has the absolute right to terminate access to the download immediately without prior notice as well as taking other appropriate actions such as claim for damages incurred if there is information that may lead to the belief that copyright infringement has occurred.

1.1.1 All Templates that contain VBA (Visual Basic Analysis) Code do not allow buyer to access and modify VBA code unless obtain a written permission from Sweet Excel. 
1.1.2 All Templates without VBA Code allow the buyer to modify the Template without restrictions.

1.2 All teaching materials (files and videos on the website) is the copyright of Sweet Excel. Allow applicants that pay tuition to study at the limit time stated upon buying the access to the course. However, teaching materials in the course, whether in whole or in part, are not allowed to be transmitted, distributed, sold or used for teaching elsewhere. Sweet Excel has the right to cancel access to teaching materials in the course immediately without prior notice as well as taking other appropriate actions such as claim for damages incurred if there is information that may lead to the belief that copyright infringement has occurred. 

2. Business (Shared License): Receipt can be issued on company name and details including but not limited to address, email address, phone number, tax payer ID, etc.

2.1 All ready-to-use templates such as Multipurpose Template, Dashboard and others are copyright of Sweet Excel. Employees with verified identity/access rights are allow to download the files, get updates and ask for support. In addition, employees specified in the terms on the receipt can use the template for work. For example, to make a presentation or a report and use the finished work or “End Product” in a presentation. But employees are not allowed to bring Template files that are not finished work or “End Product” whether in whole or in part, transferred, distributed, or sold elsewhere. Sweet Excel has the absolute rights to terminate access to the download for the whole company immediately without prior notice as well as taking other actions as appropriate for example a claim for damages incurred if there is information that may lead to the belief that copyright infringement has occurred.

Sweet Excel has the right to cancel access to teaching materials in the course for the whole company immediately without prior notice as well as taking other actions as appropriate such as claim for damages incurred if there is information that may lead to the belief that copyright infringement has occurred. 

After sales service
Order with confidence Don’t worry about being unable to download the file once you’ve purchased it. We provide assistance after purchase for a specified period of time. (We reserve the right to change the period without prior notice.)

This support includes only defects caused by the website or original files such as
1. Missing files
2. Unable to download files from email
3. Login but unable to download file
4. Unable to open file
5. The original formula has problems such as errors or inaccurate calculations.
6. There are errors in the original file.

Where the method of use, device and version of the program used must be the same as specified in the details of the Template.

This after sales service does not include any additional customization or error correction from the customized Template. However, we are more than happy to give you some basic advice. Accuracy and completeness of information
On occasion, information on the website may be errors such as misspellings, inaccuracies of information or omissions at certain points that may be relevant to promotions and offers, we reserve the right to correct any errors, any inaccuracies or omissions and in making changes update information or cancel an order if any information on the website or related services is inaccurate at any time without prior notice to you. We undertake no obligation to update, amend or clarify information on the Website. This includes, but is not limited to, price information, unless required by law. There will be no set date or date of change information stated on the website when amended or updated.

Third party services
If you have chosen to enable access or use a third-party services please note that your access to or use of such services is solely determined by the terms and conditions of that other service. We will not have a duty or responsibility for such services. This includes but is not limited to the content or the way they handle the information (including your personal data) or interactions between you and other service providers. You hereby waive the right not to make any claims from Sweet Excel in relation to such other services. Sweet Excel shall not be liable for any damages or losses that have been caused or alleged to have occurred by or in connection with your use of, access to or use of such other services; or from your trust in the treatment of privacy Data Processing Security or any other policies of such services you may be required to register or sign in to other services of that website. In order to enable such other services, you are giving your express consent to Sweet Excel only to disclose your information necessary for the operation of the service or for the activation of other services.

Contraindications to Use
In addition to other agreements set out under the contract, you are prohibited from using the website. This contract does not assign to you any intellectual property rights belonging to Sweet Excel or any third party. All rights, title and interest in such property without limitation, copyright, patent, confidentiality, any commercial and other intellectual property rights will remain with Sweet Excel solely. Trademarks, all service marks, graphics and logos used in connection with our website or our services or activities related to Sweet Excel are the trademarks or registered trademarks of Sweet Excel. Sweet Excel Trademark, Service marks, graphics and logos used in conjunction with our website or services may be trademarks of other third parties, your use of the website and service does not grant you a right or license to reproduce or use any trademarks of Sweet Excel or those of any third party.

Warranty Reserve
You agree that your use of the Website, the Services, or participation in activities related to the Sweet Excel Service, that we have organized, it is at your sole risk. You agree that such services are provided “as is”. We disclaim any express or implied warranties including but not limited to implied warranties of merchantability, suitability for a specific purpose and no incidents of violation of use. We do not warrant that the Service will meet your requirements or that the Service will not be interrupted, always available, safe or error-free. We make no warranties as to the results that may be obtained from your use of the services and your participation in activities or the accuracy or reliability of any information obtained through the services or defects arising therefrom. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Sweet Excel’s officers, directors, employees, agents, partners or licensees of Sweet Excel shall not be liable to any person for any of the following: (a) indirect damages; accidental damage, special damage, punitive damage, indemnity damage or consequential damages (including but not limited to Damage from profits, revenue, commerce, goodwill, content use impact on business, business interruption, anticipated loss of savings, loss of business opportunity). This includes, but is not limited to, contractual, tort, representation, unethical, negligent or any where Sweet Excel has been advised that such damage may occur or is expected to occur. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. The total amount of damages related to services or related activities that will be liable by Sweet Excel and any of Excel’s officers, directors, employees, agents, partners or licensor will be limited to the actual amount you have paid to Sweet Excel for a period of 1 month in advance of the event that gives rise to such responsibility. LIMITATIONS AND EXCLUSIONS WILL NOT APPLY IF THIS REMEDIES CANNOT COMPLETE DAMAGES loss or mistake in the main objective.

Indemnification
You agree to indemnify and protect Sweet Excel and its directors, officers, employees and agents from or against any liability, loss, damage or expense including reasonable attorney fees in connection with or arising out of any allegation, claim, action, dispute or proceeding of any third party dispute or claim arising out of or in connection with your content, use or service by you, your participation in activities organized by Sweet Excel or any intentional misconduct.

Separation of the null and void contract clauses
All rights and restrictions contained in this Agreement may apply. It shall be effective and binding only to the extent that such limitation does not violate any applicable law and the limited intent is to the extent necessary to not make this contract unlawful, ineffective or unenforceable. If any provision or any part of the provisions of this Agreement is unlawful, invalid or unenforceable by a court of competent jurisdiction, the parties agree that any remaining provisions or provisions will remain enforceable.

Content and Posting
You may not edit, print or copy any part of the website or taking parts of the website to combine with other tasks/websites whether in print or electronic form or any other form or take part of the website and incorporating into another website in the form of embedding, framing, or any other means without the express written permission from Sweet Excel, such actions are prohibited.

You must not upload content that is fraudulent, obscene, defamatory, threatening, invasive of the privacy rights of others or in any other way that is unlawful. You must not infringe the intellectual property of another person or company. You may not upload a computer virus or any other code intended to disrupt, damage or limit the functionality of the computer software or hardware. By submitting or uploading files on the website, you consent to Sweet Excel’s ability to remove any files at any time.

Dispute Resolution
The initiation, interpretation and performance of this Agreement and any disputes arising out of it shall be subject to the proceedings of the laws of the Kingdom of Thailand without regard to conflicts of law and rules from other countries. The sole jurisdiction and venue for legal proceedings relating to disputes subject to this Agreement shall be within the jurisdiction of the Kingdom of Thailand and you shall bring the dispute into such jurisdiction.

Transfer of Rights
You may not transfer, resell, sub-license or assign any of your rights or obligations set forth, in whole or in part, without Sweet Excel written consent, such assignment or transfer shall be void and unenforceable on all or all of the major or part of the Transfer/merger. Whereas our consent is at our sole discretion, without any other conditions.

Changes and Corrections
We reserve the right to amend this contract or the policies related to the website or service at any time. It will be effective immediately upon the publication of the latest contract on the website. We will indicate the amendment date at the bottom of the contract. Access to the website after such amendment is made your consent to such amendment.

Acceptance of the Agreement
You acknowledge that you have read this Agreement and agree to all such terms and conditions in using the website or the service. You agree to be bound by this contract. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT You will not have the right to use or access the website or such services.
